1. Introduction

Welcome to B Side Vinyl | MUSICVRS, operated by PopTech Studio LLC. These Terms and Conditions (“Terms”) govern your access to and use of our website (https://bsidevinyl.com) and any purchase made through it. By using our website or making a purchase, you agree to be legally bound by these Terms.

We may update or modify these Terms at any time without notice. Continued use of the website or services constitutes acceptance of the latest version.

2. Eligibility & Permitted Purchasers

To use our website and make purchases, you must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction

  • Provide accurate billing and shipping information

  • Be legally capable of entering into binding contracts

We reserve the right to cancel or restrict orders from any individual at our discretion.

3. Product Sales and Digital Content Licensing

a. Physical Products

We offer vinyl records, CDs, cassettes, DVDs, apparel, and music-related merchandise for sale. Inventory is subject to availability and may change without notice. Product descriptions, images, pricing, and availability are provided for informational purposes only and may contain occasional errors.

We reserve the right to cancel orders for unavailable or mispriced products.

b. Digital Products

Digital products (e.g., MP3s, FLAC files) are licensed, not sold. You receive a non-exclusive, non-transferable license for personal, non-commercial use only. Sharing, distribution, resale, or reverse engineering is strictly prohibited.

All digital downloads are delivered “as is.” If a technical issue prevents access or download, contact us at welovemusic@bsidevinyl.com, and we’ll attempt to resolve or refund at our discretion.

4. Payments

We accept major credit cards and third-party processors such as Stripe and PayPal. By clicking “Pay Now” or placing an order:

  • You agree to pay all charges listed, including taxes and shipping

  • You authorize us to charge your chosen payment method

  • You accept responsibility for all purchases made through your account

We are not liable for delays or denials by your payment provider.

5. Shipping & Delivery

Orders are shipped via trusted carriers (USPS, UPS, FedEx, etc.). Estimated shipping times are provided at checkout but are not guaranteed. Once shipped, risk of loss transfers to you.

For international orders:

  • You are responsible for import duties, customs fees, and local taxes

  • Delivery may be delayed due to customs clearance

6. Returns, Refunds & Exchanges

All sales are final, but we may accept returns for the following reasons:

  • Wrong item received

  • Product was defective or damaged in transit

To request a return:

  • Email welovemusic@bsidevinyl.com within 30 days of purchase

  • Include your full name, order number, and a description of the issue

  • We may require proof of purchase or return of the unused item

  • If approved, we’ll issue a replacement or refund (at our discretion)

Digital products are non-refundable unless undelivered due to a technical error caused by us.

Refunds may take up to 30 business days to process depending on your bank.

7. Taxes

Applicable sales tax will be added at checkout where required by law. You are responsible for any additional taxes, customs fees, or duties not collected at the time of purchase.

8. Intellectual Property

All content on our website—including music, images, artwork, text, videos, and logos—is the intellectual property of B Side Vinyl | MUSICVRS or its licensors. It may not be copied, reproduced, modified, or distributed without express written permission.

9. User Conduct

You agree not to:

  • Use the site for any illegal or unauthorized purpose

  • Interfere with or disrupt the website or servers

  • Violate any applicable laws or regulations

  • Post false, misleading, or harmful content (including reviews)

We reserve the right to terminate your access or cancel your orders for violations.

All products and services are provided “as is” and “as available.”
We disclaim all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

We are not responsible for:

  • Errors in pricing or product description

  • Third-party manufacturing defects

  • Losses due to delayed delivery, force majeure, or website outages

You agree to indemnify and hold harmless B Side Vinyl | MUSICVRS, its affiliates, officers, employees, and agents from any claims, liabilities, damages, costs, or expenses (including attorney’s fees) arising from:

12. Governing Law & Jurisdiction

U.S. Customers

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the state or federal courts of Los Angeles County, California.

International Customers

Where required by law, local jurisdictional rules will apply. Otherwise, California law governs.

13. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, punitive, or consequential damages

  • Our total liability is limited to the amount paid for the product giving rise to the claim

Some jurisdictions do not allow certain limitations, so these may not apply to you.

14. SMS and Email Communications

If you opt in to receive SMS or email marketing:

  • You consent to receive promotional and transactional messages

  • You may unsubscribe anytime by replying “STOP” or clicking “unsubscribe” links
